This presentation, led by environmental lawyers, will provide a legal update on BC’s cost recovery claim under the Environmental Management Act. The session will focus on two key aspects of BC’s cost recovery claim – who can bring such claims and the types of costs that are recoverable. Recent case law will be discussed, as well as tips and best practices to assist in the likelihood of successfully recovering remediation costs in a cost recovery action.
Adam Way is a Partner at Harper Grey and Co-Chair of the Environmental Law Group. His environmental practice involves contaminated sites litigation and risk management including prosecuting and defending actions to recover remediation costs pursuant to the Environmental Management Act, as well as appeals before the Environmental Appeal Board.
Caryna Miller is an Associate at Harper Grey and maintains a broad litigation practice spanning in technically challenging complex litigation matters, professional liability defence, class action defence, and environmental contamination. Her environmental practice is focused on risk management and cost recovery claims, and she works extensively on litigation matters related to the recovery of remediation costs pursuant to the Environmental Management Act, and related common law causes of action arising from environmental contamination.
